Take-Two and Microsoft Sign a New Long-Term Xbox Publishing Agreement — the Filing Does Not Mention GTA VI
A Form 8-K filed on September 30 says the agreement covers all Xbox devices and replaces every earlier Xbox publishing agreement between the two companies. It names no game, no figure and no end date.
Confirmed — from Take-Two’s own Form 8-K, filed with the SEC on September 30. The filing has one item, and everything below is in it.
What was signed: on September 28, Take-Two and Microsoft entered into “a new long-term XBOX Publisher License Agreement”, effective September 17, 2026. It gives Take-Two “the right to develop, publish, have manufactured, market, advertise, distribute and sell XBOX compatible products for all XBOX devices”, and it “supersedes and replaces all of the Company’s existing XBOX publisher license agreements with Microsoft.”
The terms it describes: Microsoft pays Take-Two the wholesale price or an agreed revenue share for digital products that Microsoft sells. Microsoft can review and approve each game concept and the final version of each game, including packaging and marketing that carry Microsoft’s marks. Take-Two pays fees and royalties on each physical product made for it. Either side can end the agreement over a material breach or insolvency.
Why it matters for GTA VI: this is the contract under which Take-Two publishes on Xbox, and GTA VI launches on Xbox on November 19. But the filing does not name GTA VI or any other game, and it does not mention exclusivity, Game Pass or any payment tied to one title. It follows the Xbox strategy chief’s comment that GTA VI is “breaking records for Xbox”; the filing does not refer to that either.
The limit of this story: the 8-K is a summary. It gives no end date for “long-term”, no revenue-share figure and no list of devices. Take-Two says the full text will be filed as an exhibit to its quarterly report for the period ending September 30, 2026.
